Public Offer / Terms of Service
1. General InformationThis Online Fitness Training Agreement (“Agreement”) governs the provision of remote physical fitness training services by:
Service Provider:
Irina Sergeeva Budva, MontenegroThe Service Provider provides individual physical training and fitness sessions to clients worldwide.
By purchasing or paying for any training services, the Client agrees to the terms of this Agreement.
2. ServicesThe Service Provider provides online physical fitness training services, including:
- personal fitness training sessions
- group fitness training sessions
- strength and conditioning training
- guided exercise sessions
- customized fitness training programs
All services are focused on physical exercise, movement, and fitness development.
Training sessions may be conducted individually or in a group format.
Training sessions are conducted remotely via video call or other online communication platforms.
The services do not constitute medical, nutritional, psychological, or therapeutic advice.
All services are intended for general fitness purposes only.
3. Nature of ServicesThe Client acknowledges that the services provided under this Agreement are:
- practical physical training services, not consulting or advisory services
- based on real-time or structured exercise sessions and physical activity
- intended to improve fitness, strength, and physical performance
4. Acceptance of the AgreementThis Agreement constitutes a public offer.
The Agreement is considered accepted when the Client:
- pays for training services
- purchases a training package
- books a training session after payment
Payment for services constitutes full acceptance of this Agreement.
5. PaymentTraining services must be paid in advance.
Payments may be made via:
- bank transfer
- online payment systems
- payment platforms (such as Stripe, PayPal, Wise, Paysend or similar)
All payments are processed in the currency specified in the invoice.
For group training sessions, payment may be made either by each participant individually or by one participant on behalf of the group, unless otherwise agreed.
All service fees are defined as net prices per session or package.
Payments may be subject to additional processing fees charged by banks or payment providers, which are borne by the Client.
The Service Provider is not responsible for any differences between the invoiced amount and the amount transferred due to payment processing fees, currency conversion, or banking charges.
Any minor differences between the invoiced amount and the received payment (whether higher or lower) shall not affect the validity of the payment or the number of services provided.
In case of overpayment, the excess amount may be credited toward future services unless otherwise agreed.
In case of underpayment due to transaction fees, the Service Provider reserves the right to adjust the number of sessions or request additional payment.
The invoiced amount reflects the agreed value of services provided, regardless of the final amount received after payment processing.
6. Training PackagesClients may purchase packages consisting of multiple training sessions.
Training sessions included in a package must generally be used within 3 months from the date of purchase unless otherwise agreed.
Unused sessions may expire after this period.
7. Cancellation and ReschedulingClients may reschedule a session by notifying the Trainer in advance.
Recommended notice period:
at least 12 hours before the scheduled session.
If the Client fails to attend the session or cancels too late, the session may be considered completed.
If a session cannot be conducted due to technical issues on the Service Provider’s side, the session will be rescheduled at a mutually convenient time.
8. Refund PolicyPayments for completed training sessions are non-refundable.
Refunds may be considered only in exceptional situations, such as:
- technical inability to provide the service
- cancellation by the Trainer
The Service Provider is not responsible for interruptions or inability to participate in a session caused by the Client’s internet connection, equipment, or technical issues on the Client’s side.
Such situations do not constitute grounds for a refund.
Refund requests are evaluated individually.
9. Client ResponsibilitiesThe Client acknowledges that:
- participation in physical training is voluntary
- they are responsible for their own physical condition
- they will inform the Trainer about any injuries or medical conditions
Clients are advised to consult a medical professional before starting training if they have health concerns.
10. Limitation of LiabilityThe Trainer provides professional guidance during training sessions.
However, the Trainer is not responsible for injuries, health issues, or damages resulting from:
- improper exercise technique
- failure to follow instructions
- undisclosed medical conditions
For group training sessions, participants may have different levels of fitness, experience, and physical ability.
Each participant is individually responsible for assessing their own capabilities and performing exercises at an appropriate level.
The Trainer is not responsible for the actions, behavior, or condition of other participants, nor for any injuries or damages resulting from interaction between participants.
11. Governing LawThis Agreement shall be governed by the laws of Montenegro.
